Which States Allow Abortion After the Overturning of Roe v. Wade?

After the recent overturning of Roe v. Wade, many Americans wonder how abortion rights are affected in each state. While some states have complete abortion bans, some have very few restrictions. One fact remains: Abortion is not entirely outlawed everywhere in the United States.

How Does the Overturning of Roe v Wade Impact the States?

In 1973, the Supreme Court ruled that induced abortions were a constitutional right for women. Additionally, this ruling did not necessitate a woman to have a health-threatening condition behind her decision. Instead, abortions were an elective choice.

However, in June of 2022, after nearly 50 years, the Supreme Court overturned this decision. When this happened, the Court gave each state back the power to make abortion regulations.

The people now have control over what they believe abortion laws should be where they live. By voting for delegates to speak on their behalf, each state will reflect the views of the people residing there.

What Does This Mean for Massachusetts?

The people of Massachusetts will be in control of abortion regulations as new lawmakers are eventually voted into office; time will tell how laws will change.

Currently, the state recognizes the following abortions laws that are in practice now:

  • The obtaining of informed consent is required before the abortion.
  • Unmarried individuals and minors under 16 must receive consent from a parent or legal guardian. If wishing to bypass this, a judge may approve to omit legal guardian consent.
  • Abortion is not allowed for reasons of gender preferences.

What States Currently Allow Abortions?

Following the Supreme Court’s June 2022 decision, at least 12 states now ban abortion, while others have varying restrictions.

State lawmakers are quickly moving to enforce the laws reflecting the views of those who elected them. Hence, many regulations are constantly changing with this newfound freedom for the states.
